Welcome to Nebula Print. The terms "we", "us" and "our" refer to Nebula Print. Nebula Print operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Nebula Print is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your province, state, or jurisdiction of residence, or that you have given your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.

To use the Services, including accessing or browsing our online store or purchasing any products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all activity conducted through your account. You may not transfer, sell, assign, or license your account to another person.

SECTION 2 - OUR PRODUCTS

We make every reasonable effort to accurately represent our products and services. However, colors, brightness, contrast, cropping, and other aspects of a product may appear differently depending on your screen, device, display settings, the photograph or artwork submitted, and the printing process.

Many Nebula Print products are custom-made and personalized using photographs, text, dates, names, locations, designs, or other information submitted by the customer. Customers are responsible for reviewing the information and files they provide for accuracy and suitability before submitting an order.

Minor differences between digital previews and the finished physical product may occur as a natural result of printing, manufacturing, screen calibration, and material characteristics.

All product descriptions are subject to change without notice. We reserve the right to discontinue products and to limit quantities or availability in any geographic region or jurisdiction.

SECTION 3 - ORDERS AND PERSONALIZATION

When you place an order, you are making an offer to purchase. Nebula Print reserves the right to accept or decline an order where reasonably necessary, including in cases involving payment problems, suspected fraud, product availability, technical errors, or content that we cannot reasonably produce.

Payment must be successfully processed before an order can proceed.

Please carefully review your order before submitting it. This includes uploaded photographs, names, dates, locations, spelling, customization instructions, product size, shipping information, and other personalization details.

Because personalized products may enter production shortly after an order is placed, changes or cancellations cannot be guaranteed once production has begun.

Customers represent that they have the necessary rights or permission to use photographs, artwork, text, logos, or other material they submit to us for the purpose of creating their order.

Purchases are subject to our Return and Refund Policy.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price displayed at the time the order is placed, subject to correction of obvious errors.

Unless otherwise expressly stated, prices may not include applicable taxes, shipping, customs duties, import fees, or other charges.

You agree to provide current, complete, and accurate purchase, billing, payment, and shipping information.

You represent that you are authorized to use the payment method submitted for your purchase and agree to pay all charges associated with your order.

SECTION 5 - SHIPPING AND DELIVERY

Delivery times displayed or communicated by Nebula Print are estimates and are not guaranteed unless expressly stated otherwise.

We are not responsible for delays caused by shipping carriers, severe weather, customs processing, incorrect customer-provided shipping information, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address when placing an order.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services, including our brand, logos, website design, text, graphics, photographs, videos, product designs, and other original content, are owned by or licensed to Nebula Print and are protected by applicable intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial purposes. Except where permitted by law, you may not reproduce, distribute, modify, republish, sell, or commercially exploit our proprietary content without prior written permission.

Nebula Print's name, logo, product names, designs, and branding may not be used without permission.

Shopify's name, trademarks, logos, and other intellectual property remain the property of Shopify or its respective licensors.

SECTION 7 - CUSTOMER-SUBMITTED CONTENT

When you upload a photograph, image, text, artwork, or other content for personalization, you retain your ownership rights in that content.

You grant Nebula Print a limited permission to use, reproduce, crop, resize, adjust, process, and otherwise modify the submitted content only as reasonably necessary to prepare, produce, fulfill, and support your order.

You represent that you own the content you submit or otherwise have sufficient permission to use it for the requested product.

You must not submit content that unlawfully infringes another person's copyright, trademark, privacy, publicity, or other rights.

We reserve the right to refuse an order containing material that we reasonably believe is unlawful or infringes the rights of another person.

SECTION 8 - OPTIONAL TOOLS

We may provide access to tools or services supplied by third parties that we do not control.

Third-party tools may be provided "as is" and "as available" and may be governed by the third party's own terms and policies.

Your use of optional third-party tools is at your discretion, and you should review the applicable third-party terms before using them.

Nebula Print is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Nebula Print.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Nebula Print, including any injury, damage, or loss resulting from purchased products and services.

To the extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions made directly with Nebula Print.

SECTION 11 - PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our store is powered by Shopify, Shopify may collect and process personal information relating to your access to and use of the Services in order to provide its services.

Information may also be shared with service providers involved in payment processing, order fulfillment, shipping, analytics, advertising, fraud prevention, and other functions necessary to operate our store, as described in our Privacy Policy.

We reserve the right to moderate or remove content from our Services where permitted by law.

Occasionally, information on our Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, availability, or other information.

We reserve the right to correct errors and update information where reasonably necessary, including after an order has been submitted. If a material error affects an accepted order, we will contact you where appropriate.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Nebula Print, Shopify, and their respective affiliates, employees, contractors, agents, licensors, and service providers from third-party claims arising from your unlawful use of the Services, your material violation of these Terms, or your infringement of another person's rights.

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed where necessary.

The remaining provisions will continue in effect.
